All photography services are provided by Katya Nicholas Photographer (“Photographer”). By booking a session, you (“Client”) agree to the terms outlined below.
Services may include portrait sessions, branding photography, product photography, or other agreed-upon creative services as specified in your booking or agreement.
2. Booking & Payment
A non-refundable deposit is required to secure your session date. No date is reserved until the deposit is received. The remaining balance is due on the day of session.
Payments are accepted via a credit card, and financing options like Klarna, Affirm, Afterpay.
3. Cancellations & Rescheduling
The deposit is non-refundable but may be applied to a rescheduled session if notice is provided at least 5 (five) business days in advance.
In the rare event that the Photographer must cancel, all payments will be refunded or applied to a rescheduled session.
4. Creative Direction
The Client acknowledges that:
The Photographer maintains full creative control over the session and final images;
Editing style, composition, and artistic direction are consistent with the Photographer’s portfolio;
By booking, the Client agrees they are familiar with and accept this style.
5. Image Delivery
Final edited images will be delivered within 3 (three) weeks after the shoot date via an online gallery.
Any prints or products (albums, wallart, etc) will be delivered within timelines agreed individually with each client.
Raw (unedited) images are not provided.
The number of delivered images will align with the selected package.
6. Usage & Copyright
All images remain the intellectual property of Katya Nicholas Photographer.
The Client receives a non-exclusive, non-transferable license for personal or business use (depending on session type), including:
Website use
Social media
Marketing materials
Images may not be:
Sold
Edited beyond basic cropping (without permission)
Submitted to contests or publications without written consent
7. Photographer Usage Rights
The Photographer may use images for:
Portfolio
Website
Social media
Marketing materials
If the Client prefers to keep images private, a written request must be submitted prior to the session.
8. Limitation of Liability
While every effort is made to deliver high-quality images, the Photographer is not liable for:
In the unlikely event of total image loss, liability is limited to the amount paid.
9. Force Majeure
The Photographer is not responsible for delays or cancellations due to events outside their control, including but not limited to natural disasters, illness, or government restrictions.
10. Governing Law
These Terms & Conditions are governed by the laws of the State of New York.
11. Acceptance of Terms
By booking a session, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
12. SMS Communications
By providing your phone number and opting in through our forms, you agree to receive SMS messages from Katya Nicholas Photographer. These messages may include promotional content, appointment reminders, service updates, and other transactional communications related to your inquiry or booking.
